Agreement to Terms

By accessing or using the Recally mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you may not use the Service.

Description of Service

Recally is an English reading, listening, and vocabulary application that may provide:

• Level-based stories and reading content
• Audio and narration-supported reading experiences
• Word saving, translations, quizzes, and review features
• Cross-device synchronization of account data and learning activity
• Study reminders, notifications, and learner progress features
• Subscription-based premium features and content access

Use License

We grant you a limited, non-exclusive, non-transferable license to use Recally for your personal, non-commercial educational use, subject to these Terms of Service.

You agree not to:

• Modify, copy, or create derivative works based on the app
• Reverse engineer, decompile, or disassemble the application
• Remove any copyright or proprietary notices from the app
• Transfer the app to another person or mirror it on any other server
• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the app or its systems
• Use automated systems or bots to access the Service
• Abuse content, review, translation, or subscription features in a harmful, illegal, or unauthorized way

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You may register using email/password, Google Sign-In, or Apple Sign-In. Failure to maintain accurate account information constitutes a breach of these Terms.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Content and Learning Features

Recally may provide stories, translations, explanations, recommendations, quizzes, and other learning features. By using these features:

• You acknowledge that educational content, translations, and recommendations may contain errors and should be reviewed with your own judgment
• You agree not to use the Service to upload or transmit unlawful, harmful, infringing, or offensive material
• You remain responsible for any content you submit through account, support, or feedback flows
• We may modify, suspend, or remove content or features that violate these Terms or create risk for the Service

Subscriptions and Payments

Some features of Recally may require a paid subscription. Subscription terms:

• Billing Cycle: Your subscription will automatically renew at the end of each billing period (monthly or annually) unless canceled
• Payment Processing: Payments are processed through Apple App Store or Google Play Store, subject to their respective terms
• Price Changes: We reserve the right to adjust subscription fees with advance notice
• Refunds: Subscription fees are generally non-refundable, except as required by applicable law or app store policies
• Cancellation: You can cancel your subscription at any time through your device's subscription management settings

Free Trial

Recally may offer a free trial for new users. At the end of the trial period, you will be automatically charged for the subscription unless you cancel before the trial ends. You may cancel your trial at any time through your device's subscription settings. Free trial eligibility is limited to one trial per user/device.

User Content

You retain ownership of any content or information you submit to Recally ("User Content"). By using the Service, you grant us a limited license to:

• Store, host, and sync your User Content as needed to operate the Service
• Process your User Content for support, quality, security, and product functionality
• Create backups of your data for service reliability

You represent and warrant that you have the necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

Intellectual Property

The Recally application, including its original content, features, functionality, branding, and software, is owned by Recally and its licensors and is protected by applicable intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Prohibited Uses

You may use Recally only for lawful educational purposes. You agree not to use the app:

• In any way that violates any applicable law or regulation
• To transmit any advertising or promotional material without our consent
• To impersonate or attempt to impersonate Recally, an employee, another user, or any other person
• To engage in any conduct that restricts or inhibits anyone's use of the app
• To introduce viruses, trojans, or other malicious material
• To collect or track personal information of others without consent
• To misuse content, translation, review, account, or subscription features
• To circumvent usage limits or abuse the Service

Data Sync and Offline Mode

Recally may provide account synchronization and limited offline functionality. While we strive for reliable operation, we are not responsible for data loss or service disruption caused by sync conflicts, device failures, connectivity issues, third-party platform outages, or user actions.

Disclaimer of Warranties

Recally is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• That the app will be uninterrupted, timely, secure, or error-free
• That stories, translations, quizzes, recommendations, or other educational content will be accurate, complete, or suitable for any purpose
• That the Service will guarantee language learning outcomes
• That synchronization, subscriptions, or platform integrations will always be successful

Limitation of Liability

In no event shall Recally, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, learning progress, or other intangible losses, resulting from your access to or use of or inability to access or use the app, including content errors, translation mistakes, recommendation issues, or service interruptions.

Indemnification

You agree to defend, indemnify, and hold harmless Recally and its licensors from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the app, your User Content, or violation of these Terms.

Termination

We may terminate or suspend your account and access to the app immediately, without prior notice, for any reason, including but not limited to:

• Breach of these Terms of Service
• Abuse of content, translation, quiz, subscription, or other service features
• Request by law enforcement or government agencies
• Discontinuation or material modification to the app
• Unexpected technical issues or problems
• Extended periods of inactivity

Upon termination, your right to use the app will immediately cease. You may export your data before account termination where possible.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via the app or email. Your continued use of the app after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be resolved through appropriate legal channels.
